Fundraising Guidelines
Amtgard: Kingdom of the Emerald Hills, Inc.

OBJECTIVE:

To provide members a “go to” for fundraising opportunities and to instruct members as to what functions are appropriate to raise funds for Amtgard: Kingdom of the Emerald Hills, Inc. and its parks.

APPLICATION:

Members, officers, and parks do not need pre-approval from the Amtgard: Kingdom of the Emerald Hills, Inc. Board of Directors to engage in any of the following sanctioned fundraisers. Members, officers, and parks shall not engage in any of the following non-sanctioned fundraisers.

Members, officers, and parks shall get pre-approval from the Board of Directors before engaging in any fundraisers not listed here. Due to the time-sensitive nature of some fundraisers, the Board of Directors may vote on the fundraiser via electronic mail or telephone and may inform the member, officer, or park of the approval or disapproval of the fundraiser via electronic mail or telephone.

SANCTIONED FUNDRAISERS:

1. Bake Sales
Bakes sales are allowed; however, check with the local Department of Health to determine whether a permit is needed to hold the bake sale. You must have the proper permits to conduct a bake sale.

2. Galas
Galas are allowed; however, check with your local Parks and Recreation Department and Department of Health to determine what permits, if any, are needed. You must have the proper permits to conduct a gala.

3. Community carnivals, fairs, and parades
Carnivals, fairs, and parades, whether run by the community or the park individually, are allowed; however, check with your local Parks and Recreation Department and Department of Health to determine what permits, if any, are needed. You must have the proper permits to engage in this activity.

NON-SANCTIONED FUNDRAISERS:

1. Gambling, Texas Hold’em or Poker Tournaments, etc.
Gambling in Texas is illegal. Any fundraising activity that may be considered gambling is strictly prohibited.

2. Sales of alcohol
Selling alcoholic beverages without a permit from the State of Texas is illegal. Selling alcoholic beverages by the cup is still selling alcoholic beverages. Any sales of alcohol, directly or indirectly through selling the “cup,” is strictly prohibited.

3. Raffles/Drawings
Raffles/Drawings not for “charitable purposes” are illegal. Raffles and drawings for fundraising purposes are strictly prohibited.

I am seeing a lot of proposed Fundraisers, please take a note of these guidelines before actually planning your event, and if you need to seek approval, please submit it to the BOD at their email address: bod@flail.com , or in person at a meeting.

As a note, Auctions and sales of any kind generate sales tax liability. Unless they are run by a third party entity with a sales tax license, that is aware that they will be expected to remit the sales tax themselves, these activities will not be approved.
